Professional insight

A local refusal still needs an independent test.

A refusal should be assessed against the relevant development plan, national policy, officer reasoning, submitted material and site circumstances. Tenon begins with a fixed-fee appraisal and recommends appeal only where that appears professionally justified.

Scope

The appeal appraisal considers

01

Decision notice and each reason for refusal

02

Officer or committee report where available

03

Relevant local and national planning policy

04

Planning history and submitted application evidence

05

The authority’s reasoning and evidential basis

06

Potential gaps in design or specialist evidence

07

Appeal procedure, scope and realistic alternatives

08

Lincolnshire authorities

The decision is tested in its local policy context.

Suitable appeal work is considered across Lincoln, Boston, East Lindsey, West Lindsey, North Kesteven, South Kesteven, South Holland, North Lincolnshire and North East Lincolnshire. The relevant authority and development plan are confirmed from the site and decision documents rather than assumed from a county-wide label.

The Planning Inspectorate decides appeals independently. Local experience helps frame the issues, but no consultant can guarantee an outcome.

Route forward

Appeal, redesign or resubmit on the evidence.

Where the refusal appears capable of challenge, Tenon defines the appeal case, evidence and proportionate procedure. Where a design change, negotiation or revised application is more likely to resolve the concern efficiently, the appraisal says so.

Planning appeals are subject to deadlines that vary by case type. The date and route should be checked promptly against the decision notice and current official guidance.

Planning appeal time limits can be short and depend on the case. Check the decision notice and obtain project-specific advice promptly.

Common questions

Clear answers before you begin.

How much does a planning appeal cost?

The independent Planning Appeal Appraisal is £395 + VAT. If an appeal is recommended, Tenon appeal work starts from £850 + VAT and the final scope and fee are confirmed before instruction. £200 of the appraisal fee is credited when Tenon is instructed to prepare the appeal.

Is appealing always better than resubmitting?

No. Appeal may be appropriate where the decision can be challenged on planning grounds. Redesign, negotiation or resubmission may be more proportionate where the concern can realistically be resolved.

Can you guarantee that a planning appeal will succeed?

No. The Planning Inspectorate makes the decision. Tenon identifies strengths, weaknesses and evidence, and accepts appeal work only where proceeding appears professionally justified.

Do you cover North and North East Lincolnshire?

Yes, suitable appraisal and appeal work is considered in both North Lincolnshire and North East Lincolnshire, as well as the Lincolnshire district areas.
